Water service agreement for a 24-lot subdivision

Item a - "Attached is an Annexation and Water Service Agreement for a 24-lot subdivision located on Spring Hope Road near the intersection with Easter Avenue. The developer is requesting City Council approval of the agreement in advance of closing on the property.
The agreement provides for connection to city water upon submission of an annexation petition and payment of required connection fees. The agreement further agrees that the lot will be served by septic systems in lieu of sewer, since sewer is not available to the subdivision. Additionally, the agreement provides for guarantees that the developer will be responsible for repair of any damage to the Eggers Road resulting from the residential construction activities .
Upon receipt of the annexation petition, staff will initiate the annexation process."

Recommended Action - Approve the Annexation and Water Service Agreement and authorized execution of the agreement by the Mayor, City Clerk and other appropriate Staff as needed.
